Rental Contract

This Rental Contract (“Agreement”) is entered into between Tuxedo Fashions (“We,” “Us,” or “Company”) and the renter (“You” or “Renter”) and governs the terms and conditions of the rental of products or equipment provided through our e-commerce store. By renting from us, you agree to the following terms:

1. Rental Terms

• Rental Period: The rental period begins on the date you receive the product and ends on the agreed return date specified during checkout.
• Rental Fees: You agree to pay the rental fees as outlined in your order confirmation. Additional charges may apply for late returns, damages, or missing items.

2. Use of Rental Products

• Proper Use: You agree to use the rented products responsibly and for their intended purpose.
• Prohibited Use: Do not modify, sublease, or use the products in any illegal or unsafe manner.

3. Condition of Products

• Inspection: You are responsible for inspecting the product upon delivery. Notify us immediately if the product is damaged or defective.
• Return Condition: The product must be returned in the same condition as received, except for normal wear and tear.

4. Late Returns

If the product is not returned by the agreed return date:

• A late fee of $20.00 per day will be charged until the product is returned.
• If the return delay exceeds 14 days, additional fees will apply, including the replacement cost of the product.

5. Loss or Damage

You are responsible for any loss, theft, or damage to the rented product during the rental period.

• Repair Costs: If repair is possible, you will be charged for repair costs.
• Replacement Costs: If the product is lost, stolen, or damaged beyond repair, you will be charged the full replacement cost.

6. Cancellation and Refunds

• Cancellation Policy: Cancellations made at least 14 days prior to the rental start date are subject to a $40.00 service charge. Cancellations made after this period may choose either a 50% refund or a 100% credit towards one rental within six months of original rental start date.
• No refund will be issued for any order cancelled on the rental start date or after, or after leaving the store. As a courtesy we will extend the “Past Customer $70.00 off” discount on a future rental within six months of the original rental start date.

7. Liability

We are not responsible for any injuries, damages, or losses arising from the use of the rented product. You agree to use the product at your own risk.

8. Governing Law

This Agreement is governed by the laws of California. Any disputes will be resolved in the courts of Santa Clara Country, California.

By placing a rental order, you acknowledge that you have read, understood, and agree to this Rental Contract.
